Service Terms and Conditions

THE COMPANY
Cape Mountain Guides PTY (Ltd) is a business in the tourism industry that provides adventure activities including Cape Mountain Guides.

CANCELLATIONS
There will be no refunds in the event of a no-show by guests on the activity date.
In the event of an amendment not received 3 days prior to activity booked the guest will still be responsible for the full cost for the total number of passengers originally confirmed.
Management of Cape Mountain Guides PTY (Ltd) reserves the right to cancel any activity due to unforeseen circumstances including but not limited to, insufficient passengers and/or unfavorable weather conditions.
In case of a weather cancellation, weather conditions are judged exclusively by the Management of Cape Mountain Guides.
In the event of a cancellation by Cape Mountain Guides Management, a refund will be given on the amount paid (or refunded to booking agent) less 4.6% in the case of online credit card transactions.

DELIVERY POLICY
Subject to availability and receipt of payment, requests will be processed within 2 days and delivery confirmed by way of email.

INDEMNITY
All participants are required to sign an indemnity form for all activities they are participating in prior to departure of the activity.
If a guest refuses to sign the indemnity form, the guest will not be able to partake in the activity.
The indemnity form must be signed by a Parent/Legal guardian for minors under 16 years.
Any unaccompanied child 16 or under requires the indemnity to be signed by a parent/legal guardian prior to the activity.

GENERAL
2 guests are required to run a hike on Table Mountain.
Management reserves the right to amend/cancel/add terms & conditions without notice.
All terms & conditions are subject to South African Law & Jurisdiction.
If Cape Mountain Guides (Pty) ltd does not have access to the venue of the booked service or voucher on the day of the tour then Cape Mountain Guides (Pty) ltd has the right to move the tour to another venue.

REFUND POLICY
The provision services by Cape Mountain Guides is subject to availability. In cases of unavailability, Cape Mountain Guides will refund the client in full within 30 days.

CANCELLATION POLICY
30 days cancellation before arrival 100% refund - less 4.6% in the case of online credit card transactions.
29 - 15 days cancellation before arrival 75% refund - less 4.6% in the case of online credit card transactions.
14 – 4 days cancellation before arrival 50% refund - less 4.6% in the case of online credit card transactions.
3 days-24 hrs cancellation before arrival 0% refund
If trips are canceled by Cape Mountain Guides due to bad weather then Cape Mountain Guides will refund the client in full (less 4.6% in the case of online credit card transactions.
) within 30 days.
If this product is bought as a Voucher or Gift Voucher then a 0% refund policy applies.

CUSTOMER POLICY
Cape Mountain Guides (Pty) ltd shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal
information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

PAYMENT OPTIONS ACCEPTED
Online Payment may be made via Visa and MasterCard.
Payment can also be made via Electronic Transfer or Cash on arrival.
CARD ACQUIRING AND SECURITY
Card transactions will be acquired for (Your Company) via PayGate (Pty) Ltd who are the approved payment gateway for all South African
Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the
website. Users may go to www.paygate.co.za to view their security certificate and security policy.
CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by (Your Company) separately from card details which are entered by the client on PayGate’s secure site. For
more detail on PayGate refer to www.paygate.co.za.
MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is
South African Rand (ZAR).
COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and Cape Mountain Guides chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
VARIATION
Cape Mountain Guides may, in its sole discretion, change this agreement or any part thereof at any time without notice.
